Individuals may be granted the right to participate in Constitutional Court sessions

On the portal of discussions of normative-legal acts, a draft law “On introducing amendments and addenda to some legislative acts of the Republic of Uzbekistan” has been publicized.

The developer of the document is the Ministry of Justice. The Ministry proposes to make changes and additions to the constitutional law “On the constitutional court of the Republic of Uzbekistan”.

In particular, Article 25 of the aforementioned law is proposed to be supplemented with the words “individuals and legal entities who believe that their constitutional rights and freedoms are violated by normative-legal acts that do not comply with the Constitution of the Republic of Uzbekistan”.

At present, the followings have the right to submit proposals for consideration by the Constitutional Court:

- Chambers of Oliy Majlis of the Republic of Uzbekistan;

- President of the Republic of Uzbekistan;

- The Cabinet of Ministers of the Republic of Uzbekistan;

- Commissioner of Oliy Majlis of the Republic of Uzbekistan for Human Rights (Ombudsman);

- Jokargy Kenes of the Republic of Karakalpakstan;

- a group of deputies – at least one fourth of the total number of deputies of the Legislative Chamber of Oliy Majlis of the Republic of Uzbekistan;

- a group of senators – at least one fourth of the total number of members of the Senate of Oliy Majlis of the Republic of Uzbekistan;

- The Supreme Court of the Republic of Uzbekistan;

- Attorney General of the Republic of Uzbekistan.

If the document is approved and enters into force, individuals and legal entities who believe that their constitutional rights and freedoms are violated by normative-legal acts that do not comply with the Constitution, will have the right to submit a number of proposals for consideration by the Constitutional Court.

The Ministry of Justice also offers individuals and legal entities who believe that their constitutional rights and freedoms have been violated by normative-legal acts that do not comply with the Constitution, to participate in the meetings of the Constitutional Court.

Currently, the President, the Speaker of the Legislative Chamber, his deputies, the Chairman of the Senate, his deputies, the Prime Minister, Commissioner of Oliy Majlis for Human Rights (Ombudsman), the Chairman of the Jokargy Kenes, the Chairman of the Supreme court, the Chairman of the Supreme Judicial Council, Attorney General and Minister of Justice may participate in the Constitutional Court sessions. According to the law, they have the right to state their position on all the issues under consideration.

The draft law may be amended, supplemented or rejected.
