Yuksalish nationwide movement proposes to change the order of permanent residence in Tashkent

The nationwide movement Yuksalish, based on its goals and objectives, provided its proposals and the results of studies on the issue of permanent residence in the city of Tashkent and the Tashkent region.

Paragraph 56 of the state program on implementation of the actions strategy in the year of supporting active entrepreneurship and innovative technologies provided for simplifying the procedure of permanent and temporary residence in order to guarantee the constitutional rights of citizens. These activities had to be implemented before April 1, 2018.

In pursuance of this point, the resolution of Cabinet of Ministers adopted on October 22, 2018 stated that the registration of a citizen at the place of arrival in the city of Tashkent and the Tashkent region is made for a period of five days to one year without discharge of the citizen from domicile and cannot be the basis for purchasing housing. The procedure for registering a citizen who arrived in the city of Tashkent or the Tashkent region from other regions of the republic for seasonal work (construction, agriculture, etc.) was simplified.

In accordance with the resolution, individuals who do not have a permanent residence permit in Tashkent and the Tashkent region can acquire and carry out state registration of real estate only in new buildings in the city of Tashkent and the Tashkent region by settlement through bank accounts.

At the same time, individuals who do not have a permanent residence permit in Tashkent and the Tashkent region, purchasing real estate in new buildings, must pay a state duty in the amount of 5% of the contract amount, but not less than 10 minimum monthly wages fees (at least 2,027,300 soums). (For information: citizens with permanent residence in the city of Tashkent and the Tashkent region for the same service must pay 1 MMW – 202,700 soums).

Administrative responsibility for hiring citizens without a temporary or permanent residence permit, late receipt of a passport by a minor within the prescribed period, as well as a rule providing for the possibility of refusal in hiring people without a permanent or temporary residence permit in the capital, has been abolished. 

Despite the measures taken, the issue of lifting restrictions on the purchase of housing on the secondary real estate market by citizens without permanent residence in Tashkent and the Tashkent region with the adoption of measures to prevent groundless speculation has not yet been resolved. That is, the clause of the State Program of last year was not fully implemented. This causes complaints and dissatisfaction of citizens.

The nationwide movement Yuksalish studied the opinions of citizens precisely on this issue – the current order of permanent residence in the city of Tashkent and the Tashkent region. In particular, through the Telegram channel “Jamoatchilik fikri” (“Public opinion”) from June 3 to June 11, a sociological survey was conducted. It was attended by over 17,600 people. Almost half of the respondents (49%) noted that this procedure is absolutely contrary to the constitutional rights of citizens.

Results of the study of public opinion show how relevant the implementation of this clause of the State Program, approved by the head of state.

According to the specialists of Yuksalish, with timely and full implementation of the established measures, strengthening of guarantees of the constitutional rights of citizens would help to further improve the image of Uzbekistan in the international arena, accelerate the processes of urbanization and social development. 

In view of the above and taking into account the complete fulfillment of the tasks set, the nationwide movement Yuksalish believes that it is advisable to take the following measures:

- replacing the procedure of permanent residence in the city of Tashkent and the Tashkent region on the system of registration at the place of residence. At the same time, carrying out the procedure of registration in a simplified procedure through the centers of public services and a single portal of interactive state services;

- recognizing the right of ownership of citizens who do not have a permanent residence permit in the city of Tashkent and the Tashkent region, to real estate not only in the primary but also in the secondary market, including by concluding an agreement on alienation and donation of real estate.
