Government to adopt a new resolution on payment procedures of copyright to authors

On the portal of discussion of draft normative-legal acts, the draft resolution of the Cabinet of Ministers “On the order of payment of copyright for creating dramatic, musical and musical-dramatic works for mass execution” has been posted.
According to the Regulation, payment for the copyright of dramatic, musical and musical-dramatic works for mass performances is carried out by the order of the Minister of Culture in accordance with the conclusion of the Commission for selecting and purchasing dramatic and musical works under the Ministry.
The Commission is a collegiate advisory body that carries out systematic enrichment with musical and dramatic works at the institutions of culture and arts, considering the creative value of the works.
The Commission consisting of specialists in the field of qualification shall be formed by the Ministry of Culture of the Republic of Uzbekistan and approved by a relevant order of the Minister. The Commission's activity is organized on a public basis.
Members of the Commission may be encouraged from the main job at the recommendation of the Ministry of Culture of the Republic of Uzbekistan.
Acceptance, registration and presenting the works to the Commission in accordance with the established procedure for paying the copyright for creating dramatic, musical and musical-dramatic works for mass performance will be carried out in the following order:
on dramatic and musical-dramatic works – by the Repertoire Editorial Office at the Ministry of Culture of the Republic of Uzbekistan;
on musical compositions – by the Association of Composers of Uzbekistan.
Repertoire-editorial office at the Ministry of Culture of the Republic of Uzbekistan and Association of composers of Uzbekistan are the working bodies of the Commission.
In its activity, the Commission shall be guided by the Constitution and laws of the Republic of Uzbekistan, resolutions of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, decrees and orders of the Cabinet of Ministers, orders and instructions of the Minister of Culture, as well as the present Resolution and other legislative acts.
The Commission’s main objectives are:
consideration of the works submitted by the working body;
discussing the presented works and evaluating their essence, artistic, ideological, spiritual, educational, educational value to the audience;
preparation of conclusions on copyright payment for creation of works;
defining the copyright payout amounts established by the legislation for creation of the works presented;
making recommendations on dramatization and performance of works in state theaters and concert halls;
presentation of conclusions and recommendations on the results of the work to the Ministry of Culture of the Republic of Uzbekistan.
The Commission has the following rights:
making recommendations and suggestions for authors of the works to revise and introduce their works;
involvement of leading experts in the process of reviewing the works;
requesting information from the bodies of state administration and local authorities on matters within the competence of the Commission.
The Commission is responsible for the performance of the tasks assigned to it by the present Resoltion and other legislative acts.
All works on copyright for creating dramatic, musical and musical-dramatic works for mass performance shall be submitted to the appropriate Working body on the basis of authors' applications in accordance with the established procedure.
The list of required documents together with the works submitted for obtaining copyright and the form of the application shall be developed and approved by the Ministry of Culture of the Republic of Uzbekistan.
The Commission develops and approves the procedure for reviewing the works submitted by the Working body, requirements and criteria for each work.
Conclusions on the works that are considered in the manner prescribed by the Commission and found to be positive on the copyright payment are submitted to the Ministry of Culture of the Republic of Uzbekistan.
The Ministry of Culture of the Republic of Uzbekistan considers the issue of concluding contracts with the authors in accordance with the established procedure.
At the same time, the author of the work agrees to the copyright payment for creating the work specified in the legislation of the Commission in accordance with the established procedure.
Agreements with authors for creating dramatic, musical and musical-dramatic works for mass performance:
when the payment of copyright is carried out at the expense of the State budget – by the Ministry of Culture of the Republic of Uzbekistan;
when the copyright is paid by the state theaters and non-budgetary funds of the concert organization – in accordance with the order established.
All contracts for payment of copyrights and their costs shall be subject to separate accounts at the Ministry of Culture of the Republic of Uzbekistan.
The Commission is supervised by the Ministry of Culture of the Republic of Uzbekistan.
Copies of copyrighted works that have been received by the Commission shall be kept at the Ministry of Culture.
The copyrighted works must be dramatized and performed within 6-12 months at state theaters and concert halls.
If the Ministry of Culture of the Republic of Uzbekistan does not agree with the Commission's conclusion, the Commission shall be notified within three working days with all reasonable grounds for not considering the conclusion.
