Obstinately constructed buildings will be demolished – Senator
If a person constructs a building adamantly, he cannot obtain a right to possess it. This person is not eligible to own the building he has built – he cannot sell, gift, lease or make any other agreements with regards to the building, Senator Tojibar Yuldasheva said.
On February 28, the plenary session of the Senate considered issues of strengthening responsibility for violation of land legislation.
Senator Tojibar Yuldasheva spoke at the session and said that a building, which is built illegally, must be demolished by the court's decision at the expense of the lawbreaker or by himself.
“The property right to an arbitrary one built on the permanent land plot by a person who owns and uses it as a lifetime inheritance may be recognized by the court. In that case, a person who has a property right over the building will cover the expenses of the person who constructed the building, as determined by the court,” she said.
Nevertheless, the right of ownership to an unauthorized construction may not be recognized if the preservation of an arbitrary detention infringes the rights and legitimate interests of others or threatens lives and health of citizens.
According to the results of 2018, about 1 million randomly built houses were identified within the framework of a one-time public auction on recognition of property rights for arbitrary buildings.
In accordance with the data of public service centers, since beginning of the campaign, the center has received about 38,000 applications. This is only 3.8% of the buildings that were identified as a result of the register.
It should be recalled that according to the decree of the President of the Republic of Uzbekistan of April 20, 2018, the term of one-time public auction for obtaining the right of ownership for obstinately built apartments has been set up by May 1, 2019.
