On February 2, the President signed the law PD-749 “On amendments and additions to some legislative acts of the Republic of Uzbekistan in connection with the improvement of the legislation on intellectual property”, the Ministry of Justice reported.
According to the amendments to the law “On trademarks, service marks and appellations of origin”, all legal entities or individuals can now register a trademark under their own name. Until now, only those who have carried out business activities are allowed.
The grounds and procedure for imposing a fine for violation of the legislation on trademarks and place names of origin of goods, as well as the procedure for payment of fines by legal entities are established.
Accordingly, the unlawful use of a trademark, the name of the place of origin of the goods or a type of goods that is confusingly similar to them will result in a fine of in the amount of 100 (27 million soums) to 200 (54 million soums) BCAs.
In addition, the law “On firm names” strengthens the grounds and procedure for imposing fines for violating the legislation on firm names, as well as the procedure for payment of fines by legal entities. According to Article 12-1 of the law, illegal use of company names is punishable by a fine of 100 (27 million soums) to 200 (54 million soums) BCAs.
At the same time, amendments were made to the law “On Inventions, utility models and industrial designs”. According to it, the grounds and procedure for imposing fines for violating the legislation on industrial property, as well as the order of payment of fines by legal entities have been established.
Accordingly, legal entities engaged in unauthorized manufacture, use, import, offer for sale, sale, or other entry into civil circulation of a product or item containing the relevant patented industrial property subject to a fine in the amount of 100 (27 million soums) to 200 (54 million soums) BCAs.
The amount of fines is determined separately for each type of offense. If 70% of the fine amount is paid voluntarily by the offender within 1 month, the offender is exempted from paying the remaining fine amount.
The law comes into force from the date of its official publication, only changes to the fines will take effect 3 months after the document is published in the press.
