Driver who caused 14-year-old boy's death remains free, mother demands justice

Ibrohimjon, who just turned 14, was the only son of a single mother. The mother saw her future only with him. However, a cruel fate crushed his small body under the wheels of a Malibu. The mother's hopes and dreams turned to dust, losing the meaning of her life. The driver, who was operating the vehicle without proper documentation, remains free.

This could have been just an ordinary news report on our website. However, the painful cry of the woman who approached the editorial office prompted us to look at the matter from a different perspective.

A Mother Whose Hopes Were Shattered

The tragedy faced by the woman would bring grief and suffering to anyone. The woman, whose marriage didn't work out, stayed with her son Ibrohimjon and her two daughters at her father's house, pinning all her hopes on her son's future.

However, the tragic incident on June 16 shattered her dreams and took away the meaning of her life.

Ibrohimjon, who had just turned 14, was hit by a Malibu while riding his bicycle back from his grandfather's house. The force of the impact was too great for him to survive: according to the forensic examination, Ibrohimjon died from "open head injury, fractures of the skull base, brain contusion, and brain hemorrhage, multiple abrasions on the body, post-traumatic shock, lung, and brain swelling."

The Driver Was Operating the Car Without Documents and Is Now Free

The driver A.D. was driving his business partner's Malibu with license plate 50 J 249 TA without proper documentation.

A criminal case was initiated, and an investigation was carried out. The investigation charged A.D. under Article 266, Part 2 of the Criminal Code, which refers to traffic violations causing death, and placed him under house arrest.

The driver and his passenger claimed that they were driving at 45-50 km/h and that the boy suddenly turned his bicycle into the roadway.

Ibrohimjon's mother claims that the investigation documents do not reflect the true events of the incident.

"On the day of the incident, my son immediately fell into a severe coma. He lost a lot of blood and died in the hospital within two hours of the accident. He was walking on the roadside when the Malibu, moving at 130 km/h, hit him while overtaking a Damas," she said.

The investigator listed mitigating circumstances in the indictment, noting that "the driver confessed and fully compensated for the damage." However, the mother completely denies the claim that the damage was compensated, saying she doesn't even want to hear such an offer.

Additionally, according to the investigator, no aggravating circumstances were identified for A.D. This suggests that Chortok district police investigator N. Makhmudov is unaware of Article 56, Part 1, Clause "b" of the Criminal Code. This article states that committing a crime against a minor is considered an aggravating circumstance.

Court Proceedings Have Begun

Court sessions are ongoing at the Chortok District Criminal Court regarding the case. On July 25, a Kun.uz correspondent attended one of the court sessions. The judge required that no video or photo recordings be made and that no audio be recorded.

Offenders Usually Imprisoned in Fatal Traffic Accidents

Article 266, Part 2 of the Criminal Code (Violation of Traffic Rules or Operation of Vehicles Resulting in Death) stipulates imprisonment for up to 7 years.

Kun.uz reviewed 50 court rulings from various regions involving fatal traffic accidents on the open portal of court documents. In 48 of these cases, the offenders were sentenced to imprisonment. Twelve of these cases involved the deaths of children, and in all of them, the offenders were imprisoned.
