Uzbekistan has developed a "road map for the protection of intellectual property"

The Ministry of Justice of the Republic of Uzbekistan reviewed the law and practice of law enforcement agencies in the field of intellectual property, including the Agency for Intellectual Property, reports press service of the Ministry.

High rated tariffs of registration of intellectual property objects are one of the obstacles for foreign producers to enter the Uzbek market. 

For example, according to WIPO estimates, customs fees in Bahrain are 1710, in Uzbekistan - 1,082, in the European Union - 897, in Oman - 483, in Syria - 473, in Israel - 423, in Thailand - 418, 388 in the United States, 242 in Singapore, 233 in South Korea, 151 in Turkmenistan, 148 in India, 144 in Indonesia, 143 in Turkey and 108 franc in Switzerland.

In addition, there are cases of brand-rading - the occupation of foreign brands. Representatives of the world-famous brands were faced with problems in the form of brand-rading at the entrance to the Uzbek market. Because they were branded trademarks on behalf of "cheerful" locals.

The Appeal Council on Intellectual Property of the Republic of Uzbekistan also ordered the abolition of a number of world-renowned trademark registration certificates at the request of persons who previously had a certain right to a brand. Timely detection of disturbances in this area does not pay too much attention on protecting the rights and legitimate interests of citizens (rightholders).

Typically, law enforcement agencies are working on a fundamental principle: someone should show confusion about objects of intellectual property and must solve them. It should also be noted that the law does not provide an effective compensation mechanism for losses in the interests of rightholders.

In case of violation of the trademark, a fine may vary in the amount of 1 to 5 minimum monthly wage. This is completely inappropriate for the amount of damage done. At the same time, there is no effective administrative or criminal liability for the suppression of offenses on the ground. The aforementioned errors and omissions also affect the image and rating of intellectual property rights of Uzbekistan.

Moreover, when IPRI is the only indicator in the world of intellectual property rights, such as in Azerbaijan, Armenia, Georgia, Kazakhstan, Russia and Ukraine, Uzbekistan is not recognized.

Therefore, based on the results of the analysis, the Ministry of Justice developed a resolution of the President decree "On additional measures to ensure reliable legal protection of intellectual property" and the Law on the Protection of Intellectual Property Rights Roadmap for improvement.
