Representatives of the company Diyor Biznes, operating under the brand “Molochnaya kukhnya”, criticized the business ombudsman of Uzbekistan Dilmurod Kasimov and accused him of incompetence.
Their appeal consists of the following main statements:
“We did not address you with our problem, as it is obvious to us that you were directly involved in organizing this illegal inspections of the activities of our LLC Diyor Biznes.
Your interview has further strengthened our suspicions.
At the time of the approval of the inspection on April 5, 2019, you did not have information about the presence of any cattle cemeteries, muffle furnaces and other things in the vicinity of our enterprise. Consequently, you had no reason to agree on this verification. And now you declare that you allegedly had strong reasons and hide behind a “risk analysis of possible emergencies, including dangers to human life and health, damage to the environment” and other speculation.
You tell a lie! And this deceit is refuted by documents.
You have reviewed the inspection results and found them “legitimate”? Can we study the results of sanitary and laboratory analyzes of products manufactured by us that you were supposed to be provided? Did they the find any inconsistencies in laboratories of our products? These results have so far not been provided to us.
Did it not bother you that the Deputy Chief State Sanitary Doctor of the Republic of Uzbekistan went beyond the powers granted to him by the Law and made an illegal decision?
You did not even bother to study the powers of the Chief State Sanitary Doctor granted by the legislation, since you were initially fulfilling someone’s instructions.
We understand that the person, who instructed you to “reconcile” the inspection, assured you that the Chief Sanitary Doctor was “authorized to close the enterprise”.

Do you expect that you will receive a statement from businessmen about violation of their rights and legitimate interests? And you yourself did not see this? You are not a lawyer who is invited for protection. These are your official responsibilities, the President and the Legislature of the Republic of Uzbekistan have entrusted you with these powers.
It is interesting for us why, by giving your consent to conduct an illegal inspection, you didn’t even ask what the LLC Diyor Business is, what this enterprise produces and why its dairy products were awarded numerous awards for the high quality? Why are you not even interested in our charitable activities, which exceeded 3 billion soums? Why did you not notice that the city and district SES regularly within its competencies controls and monitors our activities and our products?
From the interview it is clear that you really were not an entrepreneur and have no experience in protecting the rights of entrepreneurs, as required by the Law (article 3 of the Law-440 of 29.08.2017).
We will defend our rights in court. I hope the court will be open, and we will be able to get an explanation from you in court.
You should recognize your incompetence and illiteracy in protection of the rights of entrepreneurs ... or agree with our argument about the “by order” test.
Since you do not confess your incompetence, we will continue to work on finding and exposing the “customer” who is so much interested in “squeezing” this territory. This “customer” was the initiator of such actions five years ago, during the period of President Islam Karimov. At that time, he used the possibilities of the State Property Committee. After the death of the first President, the “customer” again made an attempt to take away the territory from us and used the possibilities of another body - the State Committee for Demonopolization. However, the “customer” was afraid that he would fall into disgrace of the new President, who proclaimed a course to support entrepreneurs. President Shavkat Mirziyoyev’s this support allowed us to defend our rights in the highest court of justice about a year ago. And now the “customer” is trying to carry out his intention with your hands. We can conclude from this that this “customer” is still in power, playing its role as a secret “puppeteer”.
We and the general public expect comments from you with explanations”.
