CabMin approves procedure for checking citizens with a breathalyzer 

In order to determine the state of violation by officers of the internal affairs or the military personnel or employees of the National Guard, the persons brought to the DIA duty units are checked for the consumption of alcoholic beverages using a breathalyzer.

The decision of the Cabinet of Ministers was adopted “On the approval of the regulation on the procedure for determining the consumption of alcoholic beverages by means of a breathalyzer in the duty units of internal affairs bodies”.

Persons brought to the duty units of the internal affairs bodies in order to determine the state of violation by the officers of the internal affairs bodies or the military servicemen or employees of the National Guard bodies are checked for the consumption of alcoholic beverages with the help of a breathalyzer.

The following will be the basis for the examination:

•  smell of alcohol from the person’s mouth;
•  the inability of a person to stand upright in one position (wobble);
•  impaired speech of the person;
•  trembling of the fingers of the person;
•  the person’s facial skin color has changed significantly.

In any situation, the responsible employees should be calm, courteous, polite and considerate with the person under examination, address them respectfully, and observe the culture and legality of dealing with them.

If a person suspected of committing an administrative offense is tested with a breathalyzer and the presence of alcohol is found in his body, in the event that this person has objections based on any of the results, in order to determine the presence of alcohol in his body, this person will be taken to the district (city) treatment and prevention institutions by the responsible personnel.

Until the duty units of the internal affairs bodies are fully equipped with breathalyzers, persons are taken to the district (city) treatment and preventive institutions in the manner established by the legislation.
