Prosecutor's office appeals controversial Yangiyul court verdict after Kun.uz criticism

In Yangiyul district, a driver responsible for running over five children and causing the death of two was initially sentenced to corrective labor by the court. The prosecutor’s office is now seeking a harsher sentence, requesting imprisonment under Article 266, Part 3, Clause “a” of the Criminal Code, which prescribes up to 10 years of imprisonment with the deprivation of certain rights.

The Tashkent regional prosecutor’s office has filed an appeal in cassation against the November 11 verdict issued by the Yangiyul district court concerning Rustamjon Mirzakhatamov. The prosecutor’s office has reviewed the legality of the court’s decision, according to Hayot Shamsuddinov, the spokesperson for the PGO.

The appeal from the prosecutor’s office calls for the annulment of the Yangiyul district court’s verdict and the imposition of a sentence under Article 266, Part 3, Clause “a” of the Criminal Code (violating traffic safety regulations, which results in fatalities). This provision stipulates a sentence of up to 10 years in prison, along with the deprivation of specific rights.

Kun.uz had previously criticized the Yangiyul district court for releasing the driver, who caused the deaths of two children in a traffic accident, from custody during the trial. A week later, the same judge issued a 2-year prison sentence for another driver involved in an accident that resulted in one fatality. Both cases were presided over by the same judge, Ulugbek Ibragimov.
