Mirziyoyev instructs Prosecutor-General's Office to develop a Code on Enforcement Procedure
Prosecutor-General’s Office of Uzbekistan will draw up a Draft Code on Enforcement Procedure within three months, follows from the decision of President Shavkat Mirziyoyev.
It is noted that the draft Code will provide for the systematization of procedural rules in the implementation of judicial acts and acts of other bodies, as well as ensuring their direct action.
The document also ensures the introduction of a software, which oversees timely and high-quality consideration of complaints received by the Bureau of Compulsory Execution through a “helpline”, as well as electronic inquiries of individuals and legal entities.
In addition, key performance indicators (KPI) of state executives will be developed to ensure the enforcement of judicial acts and acts of other bodies, as well as the procedure for applying these indicators in assessing their performance, promotion and application of disciplinary measures.
Prosecutor-General’s Office, together with the departments concerned, was instructed to submit to the Presidential Administration, within three months, proposals for the introduction of a simplified procedure for the execution of decrees imposing an administrative fine, according to which, offenders, who voluntarily pay 70% of the fine within 15 days, should be exempt from payment of the remaining amount, except in cases of the imposition of an administrative fine by the court.
At the same time, the simplified procedure for executing a decision to impose a fine does not apply in cases of appeal or protest against a decision, or a repeated commission of the same offense within a year after the application of an administrative penalty.
