Town-planning, Housing and Land Codes were introduced changes

Shavkat Mirziyoyev signed a law “On introducing amendments and addenda to some legislative acts of the Republic of Uzbekistan”.

According to the law, relevant amendments and additions have been made to the Town-planning Code of Uzbekistan. In particular, now Article 53 of the Town-planning Code is amended as follows:

“When legal and physical persons are granted land plots for building by khokims of districts, cities, requirements are established for improvement of the common use area adjacent to the construction site, as well as observance of construction time limits. If construction of the facility is not completed within the period established by the estimate documentation, and in the absence of this period in the estimate documentation, construction of the object is considered to be incomplete within two years from the date of commencement of construction”.

It should be noted that the above rule comes into force after three months.

In general, the legislators clarified what requirements for meeting construction deadlines and landscaping of common use areas adjacent to buildings are established by khokims of districts and cities when land plots are granted for legal entities and individuals for development.

Earlier, this article was described in the following manner:

“When legal entities and individuals are granted land plots for construction by khokims of districts and cities, requirements are established for meeting the deadlines for construction of facilities and landscaping of the common use area adjacent to the construction site. In cases where a new construction leads to a decrease in provision of the district’s population of this development with corresponding services below the standards stipulated by town-planning norms and rules, land plots can be granted to legal entities and individuals with their participation in the construction of additional engineering, transport and social infrastructures (except for developers of individual houses)”.

It should be recalled that on March 20, the draft of the new Town-planning Code of Uzbekistan was published on the portal of discussions of normative-legal acts. The draft of the new Code was developed by the Ministry of Construction.

In addition to it, the law made some changes to the Land Code. In particular, the ownership of land plots is terminated if the land plot provided for non-agricultural needs is not used for two years. Before this period was 3 years (this provision also comes into force after three months).

Now, membership on the council of farmers is mandatory for dekhkan farms and owners of homestead lands of Uzbekistan. In this case, upon termination of membership, the right to use the land plot is terminated. Councils, bypassing houses, monitor the rational use of land by dekhkan farms. Also, councils have the right to give instructions to farmers, dekhkan farms and owners of homestead land on the need for rational use of land.

In accordance with the changes made to the Housing Code, the spouses of children are included in the category of family members of the property ownership.
