Will you be fined when you violate traffic rules by giving way to the ambulance?

Drivers are worried about the question: what to do when there is a stop line in front of you (traffic tailback, etc.), but you want to give way to the ambulance, fire service and police cars, which have a siren on.

To stand still, not wanting to pay a fine or risk getting another? The press service of the Central Internal Affairs Directorate speaks about this issue.

Let's imagine a situation: you crossed (for example) a stop line under cameras of automatic fixation, giving way to an ambulance, fire service and police cars with a siren turned on.

The computerized traffic safety management system (CTSMS) of the Traffic Safety Department is automated: it records offenses in the field of traffic safety, composes a letter and sends it to the server of the JSC “Uzbekiston pochtasi” without a human intervention. Thus, you will receive a letter notifying about a violation, or can find out about the fact of traffic rule violation by sending a verification SMS request to the service number 8860 in the format of the State number plate of the car space + serial number of the vehicle registration (for example: 01A123AA AAC1234567).

According to article 271 of the Administrative Responsibility Code of the Republic of Uzbekistan, an administrative violation case cannot be commenced, and the commencement is subject to termination in the presence of circumstances, among which there is “an action of a person in a state of (...) extreme necessity”. Thus, when establishing the fact of the existence of this need, the recorded fact of the violation will be canceled.

Drawing up a protocol in the case of an automatic fixation of the offense is not required. Therefore, a person is not involved in this process - and unless you inform the traffic department about the problem personally, they will not be able to learn about it. So, you need to contact the staff of CTSMS at the address: Glinka Street, Yakkasaray district (the building of the ex-traffic police department).

In this regard, you will just need to calmly report that you crossed the stop line, giving way to special service cars. Explain the date, time and place to the CTSMS employee (or show the letter if available) so that he can reliably verify the fact of skipping a special car and cancel the fine. It is better to do this within seven days from the moment of “violation”, since video tapes are saved that much. 

It should be noted that according to the first part of Article 128-5 of the Administrative Responsibility Code of the Republic of Uzbekistan: “Creation of obstacles by drivers to the passage of vehicles having the right of unimpeded movement is punishable by a fine of five times MMW”. A repeated offense of this kind, committed within a year after the application of an administrative penalty, is punishable by a fine of twenty minimum monthly wages or deprivation of the right to drive a vehicle for one year.
