Justice Ministry specifies in which cases police officers can use physical force
The Ministry of Justice specified in which cases police officers can use physical force.
According to the law “On Internal Affairs Bodies”, if a person (suspect) resists by momentarily attempting to run away or giving a token push or commits other threatening sudden acts, an employee of the internal affairs body has the right to use physical force, including combat fighting techniques, in the following cases:
- for the suppression of crimes and administrative offenses;
- for the delivery to the nearest internal affairs body or other law enforcement body of the persons who committed crimes or administrative offenses, and the detention of these persons;
- to overcome opposition to the legal requirements of an employee of the internal affairs body.
It should be noted that the use of physical force must correspond to the degree of danger.
On each case of harm to the life, health or property of individuals or legal entities as a result of the use of physical force and special means, the internal affairs bodies must immediately notify the prosecutor.
