Uzbekistan increases criminal liability for unauthorized seizure of land

At the next meeting of the Legislative Chamber of the Oliy Majlis, the deputies adopted a law “On amendments and additions to some legislative acts of Uzbekistan aimed at improving the land registration system and state cadaster” in the first reading.

According to the press service of the lower house,  the number of cases of the misuse of agricultural land, unauthorized seizure, and illegal construction is sharply increasing these days. In particular, there were a total of 49,334 registered cases, with 11,269 hectares of land being arbitrarily seized. 

The draft law provides for the strengthening of existing criminal and administrative liability for unauthorized seizure of land without construction work, including the use of land without legal rights to use it or to carry out construction work on such land adjacent and not adjacent to its own land.

The law introduces new criminal measures for unauthorized occupation and construction on irrigated land, as well as for the sale or other illegal seizure of it. At the same time, a new administrative liability is established for failing to report about illegal seizure of the land by land user, as well as to failing to register non-residential objects with electric, gas, heat, water and sewage organizations supply on cadastral records.

The law provides for criminal punishment for unauthorized sale or illegal seizure of irrigated land, and strengthen state control in this area in order to detect violations in a timely manner.
