Justice Minister explains whether employees can be fired from work for refusing to get vaccinated
The Minister of Justice of Uzbekistan Ruslanbek Davletov answered the question of whether an employee can be fired from work for refusing to get vaccinated.
It should be reminded that earlier the Senate approved the law on compulsory vaccination. If the document is approved and signed by the President, then the employer will have the right to not allow the employee to work if he refuses to undergo preventive vaccination.
According to the Minister of Justice, if an employee refuses to get vaccinated, then no one has the right to forcibly send him to a medical institution for vaccination.
“Our legislation defines the types of compulsory treatment. This is alcoholism, drug addiction, tuberculosis. In these cases, on the basis of a court decision, they will be sent for compulsory treatment,” he said.
However, in case of refusal to receive the vaccine, the person will have to bear the legal consequences. For this reason, Article 113 of the Labor Code has been amended.
If the employee refuses to get vaccinated, then he will not be able to come to work. During the period of suspension from work, the employee will not be paid wages.
Davletov stressed that according to Article 100 of the Labor Code, the employer cannot expel an employee from work for refusing to receive a vaccine.
