Liability for illegal drone use being mitigated
A new norm is introduced into the Administrative Responsibility Code, which provides for administrative liability related to the illegal use of unmanned aerial vehicles.
At the plenary session of the Senate, the law “On amendments and additions to the Criminal and Administrative Responsibility Codes of the Republic of Uzbekistan in connection with the liberalization of liability for certain categories of criminal acts” was discussed.
The law introduces a new norm in the Administrative Responsibility Code, which provides for administrative responsibility for the illegal import, transfer, acquisition, storage or use of unmanned aerial vehicles, their components and spare parts.
In particular, confiscation of unmanned aerial vehicles detected as a result of an administrative offense at the expense of the state, the person who committed illegal actions, if he voluntarily hands over the unmanned aerial vehicles, their components and spare parts, is exempted from liability, and cases of administrative offenses of this category are criminal cases is determined to be considered by the courts.
Also, punishments such as alternative fines, correctional works, restriction of liberty are introduced to the sanctions specified in Article 2444 of the Criminal Code. That is, criminal responsibility is provided for such actions if they were committed after the application of an administrative penalty.
The law was approved by senators.
