Convicted Uzbek citizen justified by the Kazakh court

On December 13, the Kazakh Supreme Court justified an Uzbek citizen who was detained for failing to comply with the court’s ruling (quitting the country), the Kazakh Prosecutor-General's Office reported.

In 2016, the court of “Isatoy” district in “Atirau” region found an Uzbek citizen Tojiyev guilty of “not extraditing from the country”. In accordance with the court’s verdict, he was fined 106,000 Kazakhstani tenges ($ 290) and deported from Kazakhstan for five years.

A year later, in accordance with the press service report, the court convicted Mr. Tojiyev of “that same crime”, but this time, sentenced him to six months’ imprisonment under another article of the criminal code - “non-compliance with the court’s verdict”. 

According to the Kazakh legislation, no one can be brought back to a criminal liability for the same action.

Reportedly, the Supreme Court upheld the Attorney General’s protest and ceased the criminal case.
