Nearly 400,000 people applied to legalize their real estate property rights as of March 1
As of March 1, State Services Centers received applications for 398,400 self-built residential premises whose owners wanted to legalize their real estate property ownership rights, the General Prosecutor's Office reports.
Of all applications, 112,425 were satisfied, 48,405 were denied and 234,235 are at the consideration stage.
On April 20, 2018, the President of Uzbekistan signed a decree on one-time action recognizing ownership rights to residential premises of individuals erected on an unauthorized land plot or without obtaining a building permit.
Until May 1, 2019, the right of ownership to residential premises erected prior to the adoption of this decree on a land plot not allocated for these purposes, or without obtaining a construction permit, is recognized as that person’s own property, under the following conditions:
• this land plot (part of the plot) is not located on the area that, in accordance with the legislation, cannot be allotted for housing construction;
• unauthorized construction does not violate the requirements of town-planning norms and rules, as well as its preservation will not violate the rights and legally protected interests of other persons or pose a threat to the life and health of citizens. Specific cases in which the ownership of the unauthorized construction cannot be recognized are determined by the Cabinet of Ministers of the Republic of Uzbekistan.
Recognition of the right of ownership to unauthorized construction is carried out by the decision of the khokim of a district (city) on the proposal of the Commission formed in accordance with the decision of the Cabinet of Ministers, and subject to the rules of civil and family laws on common property.
Payment of one-time fee will be in the amount of five minimum wages.
