Khokimiyats to have employees responsible for seizure of land and providing compensations

The Ministry of Justice published a draft resolution of the Cabinet of Ministers “On additional measures to ensure guarantees of property rights of individuals and legal entities and to improve the procedure for the seizure of land and provision of compensation in connection with the seizure”.

According to the draft document, from October 1 of this year, the Cabinet of Ministers will form a sector for coordination of land acquisition and provision of compensation with participation of 3 employees.

In the structures of the Council of Ministers of the Republic of Karakalpakstan, administrations of the regions and the city of Tashkent, they form sectors for coordinating the seizure of land and provision of compensation with participation of 2 employees, and a specialist will appear in administrations of districts (cities) to work with the seizure of land and the provision of compensation.
 
Sector coordination will be entrusted to the First Deputy Prime Minister and First Deputy Chairmen of the Council of Ministers of the Republic of Karakalpakstan, khokims of the regions and the city of Tashkent.

Main tasks of the created sectors and administrative specialists will be:

- preparation of design documentation for the upcoming development in the form of presentation materials for inclusion in the Council of People’s Deputies of the district (city);

- organization of work and open discussion with the owners of real estate located on the land plot that is planned to be withdrawn;

- studying the availability of sufficient property and funds to provide compensation to owners whose real estate objects are subject to demolition;

- keeping records of agreements concluded between the initiator and the owner of the real estate, providing for the size, types and terms of payment of compensation;

- ongoing monitoring of the timely provision of compensation in full;

- submitting information to the Cabinet of Ministers on the progress of the seizure of land, demolition of real estate, compensation, as well as construction and installation works carried out on the seized land.
