Government to establish regional funds to pay for damages caused by state officials
The Legislative Chamber of Oliy Majlis has approved draft legislation designed to compensate individuals and legal entities for damages resulting from the unlawful decisions, actions, or inaction of state bodies and their officials. The new law aims to consolidate a fragmented legal landscape and provide a transparent mechanism for state budget disbursements.
Currently, compensation for such grievances is governed by more than 10 separate laws and by-laws. This lack of a unified framework has historically led to procedural confusion and a lack of clear mechanisms for making payments from the state budget. The new legislation is intended to address these gaps by establishing a streamlined legal procedure that not only ensures citizens receive restitution but also enables the state to recover those funds from the responsible parties through recourse actions.
Under the proposed law, if the state pays compensation to a victim, a right of recourse arises against the individual official responsible for the harm. The Council of Ministers of the Republic of Karakalpakstan, along with regional and Tashkent city authorities, will be authorized to bring claims against the specific state body where the official is or was employed. This "recourse" mechanism is designed to strengthen personal accountability among civil servants.
The legislation is built upon several core principles, including the primacy of human rights, the prevention of conflicts of interest, and administrative transparency. Furthermore, the document provides for the establishment of regional targeted funds specifically dedicated to property damage compensation, with clearly defined financial sources to ensure the funds are readily available when needed.
