Owner of Yangiabad campsite asks Business Ombudsman to help him against seizure

Entrepreneur Ali Tukhtayev appealed to the Commissioner for the Protection of the Rights and Legal Interests of Entrepreneurs against the seizure of the Yangiabad campsite.

In January 2019, Gulomjon Ibragimov, then the khokim of Tashkent region, decided to seize the existing tourist base that belonged to “Yangiabad Jemchujina Chatkala Ltd” for needs of state and people.

According to the owner of the campsite, the khokim violated all existing legal norms for land acquisition, as well as the rights and interests of LLC participants.

In the same year, the Administrative Court of Nurafshan City (Tashkent region) rejected the application for invalidating the decision of the khokim. The appellate court also dismissed the appeal of “Yangiabad Jemchujina Chatkala Ltd”.

“On June 18, 2019, we submitted a statement to the Prosecutor General’s Office on reviewing the khokimiyat decisions and court orders. However, to date, the Prosecutor General’s Office has not responded to our appeal, and only sent a notification about directing our application to the Tashkent prosecutor’s office, where the statement has been forgotten. We have not yet been informed of any measures taken,” a letter addressed to the business ombudsman says.

The letter also said that in December 2019, a supervisory appeal was sent to the Supreme Court against the decision of the appellate court of Tashkent region and the decision of the administrative court of Nurafshan City.

The judge of the Judicial Panel for Administrative Cases of the Supreme Court, Shukhrat Saidov, issued a decision (dated 04.02.2020), refusing to transfer a supervisory appeal to a judicial panel.

Earlier, Ali Tukhtayev told Kun.uz correspondent that he intends to bring the trial of the case to the Supreme Court.
