Prosecutor General’s Office to pay almost 1 billion soums to family of a deceased employee
On April 26, 2021, Samir Rakhmonov, a 33-year-old employee of the Prosecutor General’s Office, died. In an interview with Kun.uz, the father of the deceased said that he had first written a letter to the Prosecutor General and asked for compensation, because his son’s minor children were left without a breadwinner. However, after receiving a refusal, he filed a lawsuit with the Prosecutor General’s Office.
According to the decision of the Mirabad Interdistrict Civil Court of September 17, 2021, the plaintiff, Azamjon Rakhmonov, filed a lawsuit against the defendant, the Prosecutor General's Office, for compensation and non-pecuniary damage in connection with the death of his son.
The plaintiff then appealed to the Tashkent City Civil Court against the decision of the Mirabad Interdistrict Civil Court. The appeal was considered by the civil court of the Tashkent City Civil Court, which overturned the decision of the court of first instance and remanded the case to the court of first instance for reconsideration.
In an interview with Kun.uz, Azamjon Rakhmonov said that a forensic medical examination had not been carried out to determine the cause of death. When they tried to take Samir Rakhmonov’s body for an autopsy, he did not agree with his son’s rupture, explaining that the cause of death was known without an autopsy and that his son had a ruptured blood vessel in his brain.
Relatives of the deceased also said that on the day of the incident, the employer – the Prosecutor General’s Office – did not conduct an investigation into the death of its employee, did not draw up protocols in the manner prescribed by law.
On December 6, 2021, the court ruled that the law was violated in these cases and issued special rulings against the head of the state forensic medical examination of Sergeli branch and the head of the State Labor Law Inspectorate of the Tashkent city employment department.
Azamjon Rakhmonov died when the case was reconsidered in the court of first instance.
According to the press service of the Tashkent City Court, the trial on the claim of the deceased Azamjon Rakhmonov against the Prosecutor General’s Office of the Republic of Uzbekistan in connection with the death of his breadwinner to recover benefits and compensation for non-pecuniary damage has ended, the court decision was announced.
Due to the death of the plaintiff Azamjon Rakhmonov, by the court ruling of March 10, 2022, his claim against the PGO for recovery of benefits and compensation for non-pecuniary damage in connection with the death of his breadwinner was terminated.
At the initiative of the court, the widow of the late Samir Rakhmonov, N. Rakhmonova, who was sued by the plaintiff as an independent third party plaintiff, filed a lawsuit against the PGO in connection with the death of her spouse at work, claiming alimony, compensation of insurance and non-pecuniary damage for her minor children and herself.
According to the decision of the Mirabad Interdistrict Civil Court of March 28, 2022, N. Rakhmonova’s claim was partially satisfied.
In accordance with the court’s decision, the Prosecutor General’s Office will pay a lump sum of 951,275,952 soums and moral damages in the amount of 20,000,000 soums in favor of N. Rakhmonova., as well as a state duty of 76,642,076 soums in favor of the state.
