Traffic Safety Department owes 37 billion soums to postal service that sends notices of fines

Since the beginning of the year, “Uzbekiston Pochtasi” has sent about 9 million orders on administrative fines for traffic violations, but the Traffic Safety Service has not paid 37.5 billion soums specified in the agreement. The court ordered the MIA Department to pay the debt. Against this background, the number of cases where drivers do not receive notices of fines on time has increased.

According to court documents obtained by Kun.uz, on October 20, 2023, the economic conflict between the plaintiff “Uzbekiston Pochtasi” JSC and the defendant MIA Traffic Safety Service was considered in the Tashkent interdistrict economic court.

The Chamber of Commerce and Industry of Uzbekistan went to court as a plaintiff in the interests of the postal service.

According to court documents, on April 28 of this year, “Uzbekiston Pochtasi” and the MIA Traffic Safety Department and the Ministry of Communications signed a service agreement No. 1. However, the management did not fulfill its obligations to pay for postal services provided for in the contract.

The total amount included in the claim is 37.5 billion soums. It is known that at the first court hearing, employees of the Ministry of Internal Affairs were present, who admitted the existence of a debt and asked to postpone the hearing to another day for reconciliation and provision of additional documents to the court. However, they did not take part in the last court hearing.

At a meeting held on October 20, the court partially satisfied the claim, based on the testimony of representatives of the plaintiff “Uzbekiston Pochtasi” JSC and the documents available in the case.

In the case documents, the first party is obliged to submit decisions on the imposition of fines for traffic violations in e-form and pay for services, and the executor (plaintiff) is obliged to accept these decisions, print them, deliver them, and also provide services for exchanging information about delivery.

Based on the terms of the agreement and additional agreements concluded on its basis, in January-September 2023, the post office provided the defendant with services for the adoption of a total of 8 million 903 thousand 443 pieces of resolutions. The total amount exceeds 53 billion 420 million soums. The defendant paid 15.9 billion soums for these services. The debt of the Traffic Safety Department exceeds 37.5 billion soums ($3 million).

The postal organization’s demand for repayment of this debt was also not satisfied. The court considers the claim’s demand for recovery of the principal debt to be justified and considers it necessary to fully satisfy it. At the same time, the plaintiff’s demand for a penalty in the amount of more than 2.2 billion soums was not satisfied due to the absence of a penalty clause in the contract.

In addition, according to the court decision, 750 million soums will be collected from the Traffic Safety Department into the budget of the republic, and 45.2 million soums of state duty will be collected from the account of “Uzbekistan Pochtasi” JSC.

The parties have the right to file an appeal (protest) against the decision within one month.

According to a journalistic investigation conducted by the Sevimli TV channel, in the Samarkand region, messages about fines for traffic violations are not received on time. As a result, drivers are not able to take advantage of the benefits for timely payment of fines.
