The decree on measures to implement the tasks set at the sixth Open Dialogue between the president and entrepreneurs was adopted on August 27.
Under the decree, inspections of small businesses will generally be prohibited for three years. Exceptions include inspections conducted as part of criminal proceedings, to assess risks to human health, verify compliance with labor laws, respond to citizens’ complaints, process VAT refunds, and in connection with the liquidation of a business.
Any inspection carried out in violation of the moratorium will be considered illegal, and officials responsible for such violations will be held accountable under the law.
The presidential representative for protecting the rights and legitimate interests of business entities, known as the Business Ombudsman, will also conduct a special “Effective Oversight” program.
As part of the program, the Business Ombudsman will carry out on-site reviews of inspection materials from supervisory authorities covering the past three years.
Where violations by supervisory authorities are identified, appropriate measures will be taken within the Business Ombudsman’s powers. Where inspectors have breached established procedures or conducted unlawful inspections, steps will be taken to restore the rights of affected businesses.
