Legal status of foreigners to be noted in a separate law
A document about the legal status of foreigners has been placed on the portal of discussions of normative-legal projects. The discussion will last until February 7, 2019.
According to Norma, the draft law consists of 37 articles and regulates the following main rules on the existence of foreigners and stateless persons (SPs) in our country:
a) rights and freedoms: legal immunity, freedom of movement, labor and rest, social and pension support, education, investment and entrepreneurship, privileged taxation (for highly qualified professionals), etc.
It should be recalled that in accordance with the presidential decree #4008 dated November 7, 2018, foreign citizens, including qualified professionals are provided a range of preferences: preferential rate of the income tax - 50% of the established rate, the right to work in any position, without interfering with permitting procedures in certain circumstances, and so on;
b) entry and departure of foreigners and SPs, their transit through the territory of the country and procedure for granting political asylum.
These issues are now reflected in the following documents:
• Procedure for entry and departure of foreign citizens and stateless persons into the Republic of Uzbekistan;
• Rules of stay of foreigners and stateless persons in the Republic of Uzbekistan;
• Rules of transit of foreign citizens and stateless persons through the territory of the Republic of Uzbekistan;
• Statute on the procedure for granting political asylum in the Republic of Uzbekistan;
c) grounds for infringing the rules of stay in the Republic, including the reduction of staying term, expulsion from the country, cancellation of residence permit and permanent residence.
A detailed list of the cancellation of residence permit and permanent residence as follows:
• if foreign nationals have not returned to their permanent residence in Uzbekistan for over three years without valid reasons, their temporary exit out of the country;
• if SP exited temporarily and did not change his travel document on time without valid reasons, expiration of the validity period of travel document;
• personally applying for cancellation or appealing to another person on the basis of a power of attorney, as well as at the request of the relevant authorities abroad;
• providing deliberately false information about himself/herself or not to submit the necessary documents upon receiving a residence permit (falsification of documents);
• expelling from the country;
• according to the decision of the court on cancellation of these documents or finding the person as missing.
The project may be altered, provided addenda or cancelled.
