Uzbekistan takes inventory of damage caused to citizens during demolition

On August 3, Shavkat Mirziyoyev signed a decree “On additional measures to unconditionally guarantee the property rights of citizens and business entities”.

The above decree approved the followings:

- the composition of the republican coordination working group and territorial working groups on an inventory of the amount of damage caused to citizens and business entities during the seizure of land;

- a list of responsible persons attached to the regions to assist in the inventory;

- “roadmap” to eliminate deficiencies made during the inventory and their coverage.

The working group is tasked with conducting an inventory of damage caused to citizens and business entities, determining their real and fair size according to market value, as well as establishing specific sources of compensation for damage. If damage is caused as a result of an unlawful decision of an official, recovery from these officials in recourse is envisaged.

In addition, the working group will work on the development of specific proposals for taking measures against responsible officials and further improving the legislation.

The document says that within one month the government will make a decision providing for:

- implementation of state programs, major investment and other projects, taking into account the views of the population;

- selection of land plots occupied, first of all, by the objects of a dilapidated and emergency housing             stock, including unused ones, with public discussions with the owners of the real estate objects located in them during the seizure of land;

- obtaining the consent of owners of residential and non-residential real estate located in this territory, and concluding a written agreement on compensation for losses incurred as a result of the seizure of land.

A draft law will also be developed on enhancing the liability of officials for causing harm to owners in connection with the illegal seizure of land.
