Ministry of Justice approved an order related to the procedure of granting annual labor leave to parents of primary school children and pupils of pre-school educational institutions during the quarantine period.
According to the order, vacation may be granted to parents (guardians, trustees) of kindergarten pupils and students of 1st to 4th grades at schools during the quarantine period.
In this case, vacation leave is granted regardless of the vacation schedule.
If an employee received vacation leave before the suspension of the activities of the kindergarten or school or does not want to go on vacation, then with his consent, employers may do the following:
- temporarily transfer to remote work (flexible schedule) or work from home;
- grant unpaid vacation.
The employer issues an order on the day employee applies for vacation, indicating dates of its start and its end.
If it is impossible to go to work after the vacation ends due to the quarantine, the employee asks the employer one of the following:
- granting leave without salary, with the beginning date and estimated period indication;
- temporarily transfer to remote work (flexible schedule) or work from home.
The employer is obliged to give the employee an unpaid vacation from the date specified in the application; restrictions on the maximum period established by the Labor Code do not apply during the quarantine period.
