According to the current regulation, driving under the influence (DUI) causes administrative responsibility. Now it is expected that the punishment will be aggravated and this offense will be declared a crime. Also, evading a test while intoxicated can be a cause of criminal liability.
At the regular meeting of the Legislative Chamber on November 28, deputies considered and adopted the draft law on traffic regulations in three readings.
The draft establishes criminal responsibility for driving under the influence or for evading the inspection while intoxicated. In practice, there is administrative responsibility for this.
It is not yet known what the proposed sanction is. Last year, the head of the Ministry of Internal Affairs, Olimjon Saidov, said that those who get behind the wheel under the influence of alcohol will be deprived of their driving rights for up to 5 years.
What is the applicable liability?
According to Article 131 of the Administrative Responsibility Code, driving a car under the influence of alcohol can result in deprivation of the right to drive a vehicle for a period of 1 year, 6 months to 3 years, and a fine in the amount of 25 BCAs (8.5 million soums from December 1).
If the same offense is committed by a person who does not have the right to drive vehicles, it will result in a fine of 40 BCAs (13 million 600 thousand soums from December 1) or administrative detention for 15 days.
Currently, evasion of an examination to determine the state of intoxication is a cause of administrative responsibility according to Article 136 of the Code. In this case, the driver will be deprived of the right to drive a vehicle for 1 year, 6 months to 3 years, and will be imposed a fine in the amount of 15 BCAs (5 million 100 thousand soums from December 1).
