Gov't to pay buyers who alert authorities about non-compliant goods
The draft law “On market surveillance” has been published for public discussion.
The purpose of the law is to regulate relations in the field of market surveillance to ensure the safety of non-food products.
Economic operators who become aware that products placed on the market do not meet mandatory requirements are obliged to notify the market surveillance authority within ten days from the moment the information is obtained.
Individuals who are not economic operators but become aware that products placed on the market fail to meet mandatory requirements also have the right to report this to the market surveillance authority. The legislation may provide for financial incentives for such individuals.
Upon receiving information about products on the market that do not comply with mandatory requirements, the market surveillance authority must notify the relevant economic operator within five days.
The Cabinet of Ministers will:
- approve, within four months, the procedure for providing financial incentives to individuals who report non-compliant products in order to further strengthen public oversight of product safety;
- ensure that, within six months, state and non-state scientific institutions, with the involvement of international consultants and based on the experience of advanced foreign countries, develop a methodology for determining the amount of moral damages caused;
- align government decisions with the provisions of this law;
- ensure that executive authorities review and repeal their regulatory legal acts that contradict this law.
Within three months, the Supreme Court will create and regularly update a database of court cases from the last three years in which payments for moral damages were awarded in favor of citizens. This database will be made accessible for use by courts when reviewing cases related to moral damages.
