Constitutional court calls for stricter oversight of construction companies
Considering the negative impact of unregulated construction on the quality of life of the population and the lack of compliance with safety measures that have even led to the deaths of young children, it is deemed necessary to strengthen oversight of construction organizations to ensure safety in construction works, as well as to regulate renovation-related issues at the legislative level, according to a statement by Uzbekistan’s Constitutional Court.
At its session on December 6, the Constitutional Court reviewed and adopted a report on the state of constitutional legality in Uzbekistan.
The Constitutional Court emphasized that the rights and freedoms of individuals cannot be restricted through subordinate normative legal acts. Such norms in draft laws must strictly comply with the “constitutional principles of proportionality and sufficiency.”
In this regard, the Court supported the President’s proposal to establish compliance with the Constitution as the primary and fundamental criterion when conducting legal expertise on draft normative legal acts.
The Constitutional Court drew attention to issues raised in citizens' appeals related to ensuring constitutional rights:
- Taking into account the negative impact of unregulated construction and the lack of safety measures during construction works on the quality of life, including incidents that have led to the deaths of young children, it is considered appropriate to guarantee safety in all major construction projects, strengthen control over the activities of construction organizations, and regulate renovation-related matters at the legislative level;
- Relevant authorities must pay attention to the introduction of a system that allows individuals held in temporary detention centers during investigation and court proceedings to receive food and clothing during holidays, take walks in fresh air, and meet with close relatives and lawyers;
- Considering cases in some regions where farmers face obstacles in freely managing the products they grow, it is necessary for all responsible entities to ensure unconditional compliance with constitutional guarantees regarding the free movement of goods and services.
After reviewing these issues, the Constitutional Court approved the report on the state of constitutional legality and submitted it to the chambers of the Oliy Majlis (Parliament) and the President.
