Labor Inspectorate orders reinstatement of dismissed school principal in Buvayda

Following a Kun.uz report stating that teachers were forced to remain on duty even on days off, the Labor Inspectorate issued a written order requiring the employer to pay double wages. In the aftermath of the incident, the school principal who had been dismissed will be reinstated.

The State Labor Inspectorate conducted a review regarding the case at School No. 37 in Buvayda district of Fergana region, where teachers were compelled to remain on round-the-clock duty even on officially non-working public holidays.

As a result of the review, the employer was issued a written instruction to pay employees wages at double the rate in accordance with labor legislation. Disciplinary measures were taken against the school principal for violating labor legislation under Article 49 of the Code of Administrative Responsibility (violation of legislation on labor and labor protection).

“A submission was also sent to the higher-level organization regarding the elimination of violations of labor legislation, as well as the conditions that led to their occurrence,” the official statement said.

Earlier, against the backdrop of these events, the Fergana regional Department of Preschool and School Education reported that the school principal had been dismissed. However, according to clarification provided to Daryo.uz by Labor Inspectorate head Nilufar Amanniyazova, the department violated labor legislation when dismissing the principal.

“During a conversation with the school principal, it was established that he was not informed that his employment contract had been terminated. The employer committed a gross violation of the law when terminating the principal’s employment contract. The inspectorate not only protects the labor rights of teachers, but will also ensure the reinstatement of the school principal,” the inspectorate head said.

In addition, Amanniyazova noted that when employees are engaged to work on days off and public holidays, their consent must be obtained and payments must be made in accordance with the law.

For reference, under Articles 209 and 210 of the current Labor Code, engaging employees to work on days off and non-working public holidays is prohibited. As noted above, this requires written consent or signatures confirming agreement with an internal order issued by the head of the organization. On such days, employees may be called to work only in special cases specified in the relevant documentation.

It should be recalled that in Fergana, it became known that the instruction forcing teachers to remain on round-the-clock duty originated from the ministry and the government. According to documents published by Kun.uz, similar situations may have occurred in other regions as well.
