Ministry of Justice approves rules for online certification of notarial acts

The Ministry of Justice has registered with the state the Regulation “On the procedure for performing notarial acts via video conferencing.”

Under the regulation, notaries may perform notarial acts remotely, via video conferencing, in cases where an individual or a representative of a legal entity does not appear in person at a notary office. In such cases, notarial acts are certified through the E-notarius.uz information portal and the Notarius automated information system.

An applicant seeking to perform a notarial act via video conferencing must review the terms for using the electronic network and confirm their consent. The applicant must also clearly specify the name of the notarial act to be certified electronically and complete the required information.

From the moment an application is received, the notary reviews it within one business day and sends a notification indicating whether any deficiencies are present or absent.

During personal communication with the notary, it is required that no other persons be present at the location where the parties to the notarial act are situated, that the environment be free from noise and sufficiently well lit, and that the video image be clear.

Once the draft of the notarial act is prepared for signing, the notary explains to the parties their rights and obligations, as well as the substance and legal consequences of the notarial act being performed.
