Prosecutor General’s Office proposes driving bans and jail time for child transportation violations

The Prosecutor General’s Office of Uzbekistan has published a draft law aimed at drastically tightening the penalties for violating child transportation safety rules. The proposed legislation introduces distinct administrative liabilities, including severe fines, driving bans, and jail time for motorists who transport minors improperly.

According to the law enforcement agency, the proportion of minors among traffic accident victims remains critically high due to widespread non-compliance with basic child safety standards. The authors of the bill noted that current legislation fails to provide sufficiently clear or effective punitive measures, a gap that has contributed to the prevalence of such violations. Transporting minors without proper safety restraints or seats is highlighted as a primary threat to the lives and health of children on the roads.

To combat this trend, the Prosecutor General’s Office proposes introducing Article 128-11 to the Code of Administrative Responsibility, specifically focusing on the violation of child transportation rules and the improper organization of commercial child transit.

Under the new terms, motorists who violate child transportation rules will face an administrative fine equivalent to 30 base calculating amounts (BCA), totaling UZS 12.36 million, paired with the mandatory revocation of their driving license for a period of one to three years.

Penalties escalate heavily for individuals caught violating these rules while unlicensed or already disqualified from driving. Unlicensed offenders will face an increased fine of 50 BCAs, amounting to UZS 20.6 million, or administrative arrest for up to 15 days.

The draft law also targets corporate and institutional actors responsible for arranging child transportation, such as school bus operators or field trip organizers. Initial violations of commercial child transit regulations will carry a fine of 30 BCAs. If the same entity commits a repeat offense within one year of receiving an administrative penalty, the fine increases to 50 BCAs.

The public consultation and online discussion period for the proposed draft law is scheduled to run until July 3.
